Online signature certification in 4 steps.
Electronic signature of the document
First you sign the document electronically using Razítko. An electronic signature is binding and enforceable in court. Under Article 25 of the EU eIDAS Regulation, an electronic signature shall not be denied legal effect solely on the grounds that it is in an electronic form.
Identity verification via videoconference
The attorney creates a virtual room with a videoconference; you join it and prove your identity without the need of being physically present, using Bank iD or Identita občana (in development).
Acknowledgement of the signature as your own
In the videoconference you acknowledge your electronic signature as your own. This meets the condition for issuing the clause with a declaration of the authenticity of the electronic signature by an attorney — the so-called eLegalization.
The attorney issues the clause
Via the Czech POINT system the attorney issues a clause with a declaration of the authenticity of the electronic signature. The clause is linked to the original input document by means of a unique digital fingerprint.
Result: A declaration of the authenticity of an electronic signature (eLegalization) by an attorney has the same effects as an officially certified signature. The procedure fully complies with § 25a et seq. of the Legal Profession Act, the Act on the Right to Digital Services and other legislation.
The output of eLegalization is a clause that references the input document.
The certification clause is linked to the original input document by means of a unique digital fingerprint via the Czech POINT system. The attorney is required to record each declaration of signature authenticity in the book of declarations of signature authenticity.
Anyone in possession of the documents can verify the authenticity of the clause on the Czech POINT website.
